愛知県で認知症だった男性が電車にはねられ死亡した事故を巡る裁判で、最高裁判所は、「家族に監督義務があるかどうかは生活の状況などを総合的に考慮すべきだ」との判断を下しました。そして今回のケースでは監督義務はなかったとして家族の賠償責任を認めない判決が言い渡されたということです。
The Supreme Court on Tuesday dismissed a suit that demanded the family of an elderly dementia patient, who was killed by a train, pay a railway operator damages for disrupting train services, overturning lower courts’ rulings.
The plaintiff — Central Japan Railway Co. (JR Tokai) — lost the case by the top court decision, which all five participating justices supported unanimously.
In its first ruling on a case of this type, the court said, “Whether a family member of a dementia patient is liable for damages should be decided based on such conditions as whether they are able to supervise such a patient and do so without difficulties.” The ruling was handed down by the top court’s Third Petty Bench with Justice Kiyoko Okabe presiding.

"handed down"を取り上げます。『ジーニアス英和辞典』によると「遺産を引き渡す」といった意味がありますが、ここでは「判決などを言い渡す」という意味になっています。LDOCEでは "to officially announce a decision, punishment"とありました。語源を調べてみると、元々競走馬の騎手が自分の馬にむちを打たなくても勝てると考え、つまり手を下げたままでも勝てるということで、使われるようになった表現だということがわかりました。(lua)
