Top court judges couple surname rule constitutional
TOKYO (Kyodo) -- The Supreme Court ruled Wednesday that a legal provision forcing married couples to use the same surname is constitutional, while it found another rule prohibiting women from remarrying for six months unconstitutional.
Lawsuits that sought to highlight the century-old rules as discriminatory and outdated have been filed over the two Civil Code articles. The top court said a remarriage ban on women that exceeds 100 days violates the Constitution.
Plaintiffs argued the rules infringe on the Constitution's guarantee of equality and individual dignity. The articles have been retained as moves in the past to revise them lost momentum, leaving Japan out of step with other countries.
